Terms of Service
These Terms of Service ("Terms") govern your purchase and use of the Beaconry WordPress plugin ("the Software") published by MALUR — IT Consulting & Services Ltd ("MALUR", "we"). By purchasing a license you accept these Terms.
1. Parties and Roles
MALUR — IT Consulting & Services LtdLimnaria 1, Westpark Village, Shop 20
8042 Paphos, Cyprus
Company Registration: HE 430277
VAT ID: CY10430277A
Checkout, payment processing, VAT collection, invoicing and license-key issuance are handled by Polar Software Inc. (Polar) as our Merchant of Record. Polar is your contractual counter-party for the payment transaction. MALUR is the licensor of the Software and the support provider.
2. License Grant
Subject to your payment of the applicable fee, MALUR grants you a non-exclusive, non-transferable license to install and operate the Software on the number of production sites covered by your tier:
- Solo: 1 production site.
- Studio: up to 5 production sites.
- Agency: unlimited production sites for clients you build for.
Development, staging, and pre-launch activations are unlimited on every tier. The Software code itself is licensed under GPL-2.0-or-later (as required for any WordPress plugin). License keys, plugin updates delivered via our update server, support, and the Beaconry brand are proprietary and not covered by GPL.
3. Fair Use of Agency Tier
"Unlimited" on the Agency tier means unlimited sites that you build, host, or maintain for your own clients. Re-distributing the Software to non-client third parties, sublicensing it as part of a SaaS multi-tenant offering where end-users do not run their own WordPress install, or operating a public license-key broker is not covered. Reach out to us if your use case is on the edge and we'll find a fair arrangement.
4. Reselling and Redistribution
Because the plugin code is GPL-2.0, you may technically redistribute it. However, you may not (a) redistribute the Software under the Beaconry name or branding, (b) sell or transfer Beaconry license keys, or (c) operate a clone or fork that consumes our update-manifest endpoint or our license-validation API. The brand "Beaconry", the logo, and access to our update + license servers are proprietary.
5. License Suspension and Deactivation
We may suspend or deactivate a license if (a) the corresponding payment is reversed or charged back, (b) you breach Section 3 (Fair Use) or Section 4 (Reselling), or (c) you use the Software in violation of applicable law. We will give you 14 days' notice and an opportunity to remedy the issue, except where required by applicable law to act sooner. Where mandatory consumer-protection law of your country grants stronger rights, those rights prevail.
6. 14-Day Money-Back Guarantee
If Beaconry does not work for your site for any reason, email info@beaconry.app within 14 days of purchase and we will refund the full amount via Polar. This guarantee is granted in addition to any statutory rights you may have under EU consumer-protection law. Refund requests beyond 14 days are evaluated on a case-by-case basis.
7. Updates and Support
An active license entitles you to plugin updates and email support for the duration of your license. Lifetime licenses (the default at launch) entitle you to lifetime updates as long as MALUR continues to publish them. We commit to publishing security updates for at least 24 months after a major version is superseded.
8. Use of Google Ads API (Beaconry Plugin)
When you click "Connect with Google Ads" in the Beaconry plugin, you authorise Beaconry to upload click conversions to your own Google Ads account on your behalf, through the Beaconry OAuth broker (oauth.beaconry.app, operated by MALUR Ltd).
You remain at all times the owner of your Google Ads data. Beaconry holds uploadClickConversions access only — no read access, no write access for campaigns, budgets, or keywords.
By connecting, you additionally accept Google's own API Services Terms of Service and the Google API Services User Data Policy.
You can end the connection at any time via the plugin (see Privacy Policy) or directly at Google. On disconnection, Beaconry deletes the OAuth tokens from the worker KV without delay (within seconds, via /google-ads/disconnect).
MALUR does not guarantee conversion-upload availability beyond the daily quota (Google Ads Basic Access = 15,000 operations/day, shared across all Beaconry customers). When the quota is exhausted, Google's API responds with HTTP 429 — the plugin logs the failure and does not retry.
9. No Warranty
The Software is provided "as is", without warranty of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, MALUR shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with your use of the Software. This limitation does not apply to liability for intent, gross negligence, or where mandatory law requires otherwise.
10. Data Protection
See our Privacy Policy for how we handle personal data.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Cyprus, excluding its conflict-of-law rules. The exclusive place of jurisdiction is Paphos, Cyprus, except where consumer-protection law of your country of residence grants you the right to sue in your local courts.
12. Changes to These Terms
We may update these Terms from time to time. The version date at the top of this page reflects the most recent revision. Material changes affecting active license holders will be communicated by email; you may terminate your license within 30 days of such notice if you do not accept the changes.
